Sukarne, S.A. DE C.V., Sukarne Agroindustrial, S.A. de C.V., Operadora de Personal Técnico, S.A. de C.V., and/or subsidiary, affiliated and/or service provider companies (hereinafter “SUKARNE”), indicating for the purposes of this Privacy Notice the address located at Avenida Diana Tang 59 A, interior A, Desarrollo Urbano La Primavera, Culiacán, Sinaloa C.P. 80300, is responsible for the processing of the personal data that has been provided to it by the natural persons (hereinafter “Data Subject”/“Data Subjects”) to whom they correspond.

Based on Article 15 and 16 of the Federal Law on the Protection of Personal Data Held by Individuals and its regulations, SUKARNE is responsible for collecting personal data, the use it gives to them and their protection.

The Personal Data provided will be processed in accordance with the principles of lawfulness, consent, information, quality, purpose, loyalty, proportionality, and accountability, as established by law. The confidentiality of the Personal Data is guaranteed, and it is protected by administrative, technical, and physical security measures to prevent damage, loss, alteration, destruction, misuse, unauthorized access, or disclosure.

In accordance with the Federal Law on the Protection of Personal Data Held by Private Parties and with this notice, the following definitions shall apply:

  • Personal Data: Any information concerning an identified or identifiable natural person.
  • Sensitive Personal Data: Personal data that affects the most intimate sphere of its owner, or whose misuse could give rise to discrimination or entail a serious risk for the owner. In particular, sensitive data includes information that may reveal aspects such as racial or ethnic origin, current and future health status, genetic information, religious, philosophical, and moral beliefs, trade union membership, political opinions, and sexual orientation.
  • ARCO Rights: Rights of Access, Rectification, Cancellation and Opposition provided for in the Federal Law on the Protection of Personal Data Held by Private Parties

  • Data Subject: The natural person to whom the personal data corresponds.

“SUKARNE” is dedicated to the processing, production, marketing, distribution, import and export of animal protein and by-products; “SUKARNE” also provides and receives consulting, advisory, administrative, technical and supervisory services from individuals and legal entities; by virtue of the foregoing, “SUKARNE” interacts and has interacted with various individuals, who are the “Owners” of the Personal Data (hereinafter “Data”) that was collected from them at some point, or that is collected in this act, therefore, “SUKARNE” makes known to them the type of “Data” it collects, the profile of each individual and the treatment and/or purpose given to them, in accordance with the following:

Regarding the “Data” of the WORK PERSONNEL (job applicants, employees, former employees, contract workers, interns), “SUKARNE” collects information, personally and/or directly from the aforementioned “Data Subjects” in consideration of the services and/or functions to be performed, which are the full name, address, Federal Taxpayer Registry (RFC), Unique Population Registry Code (CURP), Social Security Number (IMSS), telephone, email, professional experience, letter of no criminal record, union affiliation, proof of studies, proof of address and copy of some official identification; in order to determine the consideration and/or remuneration of the services provided and the making of the determined payment, as well as the communication and location of the person, identification of the same, preparation of a professional profile, which serves for the evaluation and training of these, as well as to make some employment recommendation; “SUKARNE” may request the full name and telephone number of immediate family members (ascendants, descendants, collateral relatives, and/or spouse) for employment reference purposes. If “SUKARNE” collects information about any employee’s bank account, this financial data will only be collected to facilitate payment, either by bank transfer or electronic transfer, for services and/or goods provided. “SUKARNE” may, at any time, request information from any of the aforementioned “Account Holders” and/or conduct socioeconomic, psychometric, and/or medical (health status) evaluations for institutional purposes to help define an account holder’s profile in order to determine and/or provide benefits and/or support in specific situations.

“SUKARNE” may also request and/or collect “Data” from EMPLOYEES and/or their immediate family members (ascendants, descendants, collateral relatives, and/or spouse), including information on illnesses and/or accidents (health status) of the aforementioned “Data Subjects,” as well as information on the vehicles they use. This is done to evaluate, quote, and, if applicable, provide any type of Medical Expense Insurance, Life Insurance, and/or Auto Insurance, as an employment benefit related to their position and/or duties. Among the “Data” collected from the “Data Subjects” and/or their family members is information considered “Sensitive Personal Data,” the processing of which is authorized by “SUKARNE” upon acceptance of this Privacy Notice or by not objecting to or refusing its processing.

Regarding CUSTOMER “Data”, whether distributors or consumers, “SUKARNE” collects personal information from two types of customers:

  1. Client-distributor, from whom the full name, address, telephone and/or email, Federal Taxpayer Registry (RFC), Unique Population Registry Code (CURP), internet page (website), bank account details, copy of some official identification are requested; in order to determine the consideration and/or remuneration for the supply of the products and/or services that “SUKARNE” provides, the corresponding collection and payment, as well as the communication and location of the Client-Distributor.
  2. Customer-Consumer, from whom the full name, address, telephone and/or email address, date of birth are requested, for the purpose of evaluations on the products and/or brands and/or services of “SUKARNE”; in order to obtain a result of Market Studies, as well as to contact them for the sending of advertising and/or clarifications, by email and/or by other means of communication.

Regarding CUSTOMER “Data”, whether for credit applications or any formal means of payment, “SUKARNE” collects personal information from two types of customers:

  1. Customers paying in cash:
    • Fulfillment of the product order request;
    • Preparation of the corresponding contract (if applicable);
    • Delivery of the requested order;
    • Receipt of payment for the product delivery;
    • Completion of the corresponding invoicing procedure;
    • Addressing any questions, comments, suggestions, and complaints submitted to SuKarne; and
    • Follow-up on customer satisfaction regarding the product order.
    1. Customers paying on credit:
    • Responding to the credit application;
    • Approving or rejecting the credit application;
    • Fulfilling the product order;
    • Preparing the corresponding contract;
    • Delivering the requested order;
    • Receiving payment for the product delivery;
    • Carrying out the corresponding invoicing procedure;
    • Collecting payments for late or non-payment;
    • Addressing any questions, comments, suggestions, and complaints you may have for SuKarne; and
    • Following up on customer satisfaction with the product order.

    Regarding SUPPLIER “Data,” “SUKARNE” collects information consisting of the full name, address, Federal Taxpayer Registry (RFC), telephone number, email address, quote and/or estimate, proof of address, and a copy of an official identification document; for the purpose of identifying and locating the “Data Subject,” determining the consideration and/or remuneration for the services and/or goods provided and/or supplied to “SUKARNE,” as well as for processing the payment. If information is collected about any bank account of the aforementioned “Data Subjects,” this financial data will only be collected for the purpose of facilitating payment, whether by bank deposit or electronic transfer, for any service and/or supply.

    “SUKARNE” will maintain and implement appropriate protection actions and mechanisms, which will consist of the necessary Administrative, Physical and Technical Measures according to its capacity and the type of “Data” it processes; with the purpose of guaranteeing the security, integrity and privacy of the “Data”.

    The processing of the “Data” that has been made available to “SUKARNE”, whether personally, directly and/or indirectly by its “Owner”, may be carried out in accordance with these terms and conditions, so that, from this moment it is understood that the “Owners” give their consent for said processing, unless there is an express communication in the same way in which the “Data” was collected, so that the “Owner” expresses to “SUKARNE” their refusal to the processing of their “Data”, following the mechanisms indicated below, through the request of the ARCO Rights.

    “SUKARNE” is responsible for the collection, safekeeping, and processing of your “Data.” You may at any time exercise your rights of Access, Rectification, Cancellation, or Opposition (ARCO) with respect to your “Data” by submitting a written request to “SUKARNE,” Personal Data Department, at the following address: Avenida Diana Tang 59 A, interior A, Desarrollo Urbano La Primavera, Culiacán, Sinaloa, C.P. 80300, during business days and hours, or by email to avisodeprivacidad@sukarne.com. You may also, through these means, express your refusal to the processing and transfer of your “Data”, as well as revoke your consent to the processing of your “Data” and the limitation of its use or disclosure. You may at any time access the ARCO Rights Request at the address indicated above, by requesting it via the email address mentioned, as well as on our website “https://www.sukarne.com/” www.SUKARNE.com.

    We inform you that the owners of the Personal Data you have provided to us may exercise their Right to Revoke Consent at any time during the processing of their Personal Data, as well as exercise their Rights of Access, Rectification, Cancellation or Opposition (hereinafter “ARCO Rights”), with respect to their Personal Data, in the following way:

    • Those interested in exercising their ARCO rights may send an email to avisodeprivacidad@sukarne.com, through a free-form letter complying with the provisions of article 29 of the Federal Law on the Protection of Personal Data Held by Private Parties.
    • If the request is deemed valid, you will be notified within a maximum period of twenty days from the receipt of your request, which will be made effective within fifteen days following the date on which the corresponding response is communicated.
    • The information will be delivered electronically to the email address you provide free of charge; we may only charge for justified shipping costs or those derived from issuing copies and/or other formats, which will be communicated to you in advance.

    “SUKARNE” may assign and/or transfer the “Data” to both individuals and legal entities, whether domestic or foreign. If you, as the “Data Subject,” sign this Notice or do not exercise your right to object as provided in this Privacy Notice, it will be understood for all corresponding legal purposes that you, as the “Data Subject,” authorize, if necessary, at “SUKARNE’s” discretion, the assignment and/or transfer of your “Data.” The recipients of such “Data” will be subject to the provisions of this Privacy Notice. Accordingly, “SUKARNE” may need to transfer the “Data” to third parties with whom it maintains commercial or professional relationships. Similarly, “SUKARNE” may transfer “Data” corresponding to its employees, interns, applicants, candidates, and/or contract personnel to third parties, such as external firms, laboratories, and/or clinics, solely for the purpose of conducting research, evaluations, medical examinations, selection processes, and providing opinions related to its personnel. These third parties will receive the “Data” solely and exclusively as part of the commercial and/or professional relationship with “SUKARNE”, as part of the scope and/or as information necessary for the improvement of the internal, commercial and/or professional relationships agreed between “SUKARNE” and the “Owners”.

    “SUKARNE”, in accordance with the technologies implemented for the daily performance of its functions, may collect information containing “Personal Data” through its website; however, it does not collect this type of information through cookies and/or web beacons, nor through social media.

    Personal Data will be kept for a period of 5 (five) years in physical and electronic media, and subsequently discarded, in order to avoid improper treatment of the same, based on article 11, second paragraph of the Federal Law on the Protection of Personal Data Held by Individuals.
